Cohabitation and Unmarried Individuals

Overview:

Common Law marriage in England and Wales is an urban myth, and claims in respect of assets differ wildly depending on whether you are married or not, and if unmarried, whether you have children or not.  Unmarried partners have fewer rights to argue over the distribution of assets, such as houses and companies, and it is important to protect yourself and make sure you are getting sensible, practical advice.

There are many ways in which you can ensure that your ownership and access to assets is preserved and secured, and that you are able to ensure that should you separate, you are protected.

We have a wealth of experience in advising unmarried people in relation to their financial arrangements, living with their partners and protecting their personal possessions.  We can advise you on the following:-:

    • Crystalising day to day living arrangements in Cohabitation agreements;
    • Preparing and drafting Declarations of Trust;
    • Determining your share in a property and civil claims through the courts;
    • Providing for arrangements on the breakdown of a relationship;
    • Advising you in relation to housing any children from your relationship.
